Terms of Service

Pivot Pointe Counseling Center, PLLC ("we," "our," or "us") offers clients the ability to communicate via text messages and emails for convenience in receiving appointment reminders, notifications, and other service-related communications. By providing us with your contact information, you agree to the terms and conditions outlined below.
1. Consent to Receive Communications
By providing your mobile number and email address, you agree to receive:
a. Text Messages: Appointment reminders, scheduling changes, confirmations, and urgent notifications related to your services.
b. Emails: Updates regarding our services, billing information, newsletters, and non-urgent communications.
You consent to receive text messages and emails from Pivot Pointe Counseling Center at the mobile number and email address you have provided. Standard message and data rates may apply based on your mobile carrier's plan.
2. Opting Out
You may opt out of receiving communications at any time:
a. Text Messages: Reply "STOP" to any text message you receive from us to opt out of future text communications.
b. Emails: Click the "Unsubscribe" link at the bottom of any email you receive from us to stop receiving future emails.
Please note that opting out of certain communications may limit your ability to receive important information about your appointments, treatment, or services. For urgent matters, we may still contact you by phone if you have opted out of text or email notifications.
3. Protected Health Information (PHI)
In compliance with the Health Insurance Portability and Accountability Act (HIPAA), we will not send any sensitive health information, such as diagnosis or treatment details, through unsecured text messages or emails.
a. Emails: We may communicate general information or appointment-related content through email. However, we will not include PHI unless we use a secure, encrypted email service, which requires additional consent.
b. Text Messages: Text messages will only contain non-sensitive information, such as appointment reminders or scheduling notifications. No health-related or clinical information will be transmitted via text.
For detailed health-related communication, we encourage you to use secure methods, such as our patient portal or in-person conversations.
4. Security
While we make every effort to protect your personal information, please be aware that text messages and standard emails are not completely secure communication channels. By agreeing to receive communications via text or email, you acknowledge the following:
a. Email Risks: Emails can be intercepted, altered, or stored by third parties without our knowledge. We recommend that you do not share sensitive or confidential information via email unless instructed to do so through an encrypted service.
b. Text Message Risks: Text messages may be read by others who have access to your phone or carrier network. Be sure to protect your phone with a password or security measures.
We are not responsible for any unauthorized access to your information if it is transmitted through unsecured channels.
5. Third-Party Services
We may use third-party services to manage email and text message communications. These service providers are required to protect your information and comply with privacy standards, including HIPAA when applicable.
6. Frequency of Communications
The number of text messages and emails you receive will depend on your engagement with our services. Common scenarios include:
a. Appointment Reminders: You may receive reminders 24 to 48 hours before your scheduled appointment.
b. Notifications: If there are any changes to your appointment or urgent updates, we will notify you via text or email.
c. Marketing Emails: You may receive occasional promotional emails, newsletters, or event invitations unless you opt out.
7. Responsibility for Charges
Pivot Pointe Counseling Center is not responsible for any charges incurred for text messages or emails, including those related to mobile data plans or carrier fees. You are responsible for any fees assessed by your mobile carrier or email service provider.
8. Changes to This Policy
We may update these terms and conditions from time to time. When changes are made, we will update the "Effective Date" at the top of this document. Continued use of our text message and email services constitutes your acceptance of the revised terms.
9. Contact Us
These terms and conditions are governed by and construed in accordance with the laws of Texas and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
